1. Acceptance of these Terms
By creating a Cupside account, downloading the Cupside app, or using any part of the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area, unless local law sets a different threshold) to use Cupside. If you are under the age of majority in your country, you confirm that your legal guardian has reviewed and approved these Terms.
3. Your account
- You are responsible for keeping your credentials secure.
- One person, one active account. Shared and bot accounts are not allowed.
- You must provide accurate information and keep it up to date.
- We may suspend or terminate accounts that violate these Terms.
4. Acceptable use
You agree not to:
- Cheat, exploit bugs, use unauthorized clients or modify gameplay data;
- Submit false match results, fake screenshots or fabricated proof;
- Harass, threaten, dox or impersonate other users;
- Post hateful, illegal, sexually explicit or otherwise harmful content;
- Spam, scrape, reverse-engineer or interfere with the Service;
- Sell, transfer or share your account, clan or league;
- Use the Service in violation of applicable laws or sanctions.
We use a zero-tolerance policy for objectionable content and abusive users in user-generated content (chats, clan boards, profiles). You can report content or block users from inside the app, and we aim to review reports within 24 hours.
5. Competitions, results and disputes
- Match results submitted in Cupside become authoritative once both players confirm them, or when an admin resolves a dispute.
- League and tournament organizers can set additional rules. By joining a competition you accept those rules.
- We may apply walkovers, reset matches, recompute standings or remove users from competitions when fair play is breached.
- ELO and stat adjustments resulting from result reversals are final.
6. Subscriptions and payments
Cupside offers a free tier and paid "Pro" subscriptions. Pricing, billing periods and features available in your region are shown on the Pricing page and inside the app at the moment of purchase.
- Mobile subscriptions are billed by Apple App Store or Google Play and are subject to their terms.
- Subscriptions auto-renew until cancelled. You can cancel any time in your App Store or Google Play account; cancellation takes effect at the end of the current period.
- We do not control refunds for App Store or Google Play purchases. Refunds are handled by the respective store.
- We may change prices for new billing periods. Existing subscribers will be notified before the change takes effect.
7. EEA right of withdrawal
If you are a consumer in the EEA, you have a 14-day right of withdrawal for digital subscriptions. By starting your subscription you expressly request immediate access and acknowledge that you lose your right of withdrawal once the digital content has been supplied.
8. User content
You keep ownership of the content you submit (messages, screenshots, clan logos, profile data). You grant Cupside a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display and adapt that content solely to operate, improve and secure the Service.
9. Intellectual property
The Cupside name, logo, app interface and codebase belong to us or our licensors. Cupside is an independent product and is not affiliated with or endorsed by Konami Digital Entertainment or other game publishers.
10. Termination
You can stop using the Service at any time and delete your account from cupside.app/account/delete. We can suspend or terminate your account if you violate these Terms, with or without notice depending on the severity. On termination, you lose access to paid features for the remainder of your billing period unless required otherwise by law.
11. Disclaimers
The Service is provided "as is" without warranties of any kind, except those that cannot be excluded under applicable law. We do not guarantee uninterrupted availability, that scores will be free of errors, or that competitions will run on a specific schedule.
12. Liability
To the maximum extent permitted by law, Cupside is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, goodwill or data. Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (such as for gross negligence or willful misconduct).
13. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Mandatory consumer protections of your country of residence still apply. Disputes will be resolved by the competent Polish courts, unless mandatory law gives you the right to bring proceedings before the courts of your country of residence.
14. Changes
We may update these Terms. We will notify you of material changes through the app or by email at least 14 days before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
