End User License Agreement

This End User License Agreement (the “EULA”) is a contract between you and Cupside that governs your use of the Cupside mobile application (the “App”). Use of the App is also subject to our Terms of Service and Privacy Policy.

1. License

Subject to your compliance with this EULA and our Terms of Service, Cupside grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control.

2. Restrictions

You will not:

  • Copy, modify, translate or create derivative works of the App;
  • Reverse-engineer, decompile or disassemble the App, except where allowed by law;
  • Remove proprietary notices, branding or labels;
  • Rent, lease, lend, sell, redistribute or sublicense the App;
  • Use the App to develop a competing product.

3. App Store sourced applications

If you obtained the App from Apple App Store or Google Play, the following applies in addition to the rest of this EULA:

  • This EULA is concluded between you and Cupside only, not with Apple or Google. Cupside, not the store, is solely responsible for the App and its content.
  • The App may only be used on devices that you own or control and as permitted by the App Store Terms of Service or Google Play Terms.
  • Apple and Google have no obligation to provide maintenance and support services for the App.
  • To the maximum extent permitted by law, Apple and Google have no warranty obligation whatsoever with respect to the App.
  • Apple and Google are third-party beneficiaries of this EULA and may enforce it against you.

4. Updates

Cupside may release updates, patches and new versions. The license in Section 1 covers updates that replace or supplement the original App, unless a separate license is provided.

5. Termination

This EULA is effective until terminated. It terminates automatically if you fail to comply with any of its terms. On termination you must stop all use of the App and delete it from your devices.

6. Disclaimer and liability

The App is licensed "as is". The disclaimers and liability limits in our Terms of Service apply to this EULA as well.

7. Governing law

This EULA is governed by the laws of Poland, without prejudice to mandatory consumer protections in your country of residence.
